Court to Reexamine Ruling That Permitted Former President to Deploy Military Forces to Portland
The ninth circuit court has upheld a prohibition on sending state troops in the Oregon city, following a latest legal decision.
Judicial Panel Concurs to Reconsider Legal Matter
The ninth circuit court of appeals ruled on this week that it would rehear the case concerning the president’s authority with an expanded group of 11 judges. The court also overturned a previous decision from a three-judge panel that had supported the federal government.
Ongoing Dispute Over Military Presence
This order represents the most recent turn in a protracted court case over whether the former president has the authority and justification to send national guard forces in the city. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was started in response to months of protests.
Differing Viewpoints
The administration has claimed that federal officials at the ICE facility in south Portland were facing threats, while local authorities assert that municipal police have command of the situation.
Contrary to descriptions of the city as a conflict zone, residents have been sharing footage of lush hiking trails and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the increased military presence.
Court Proceedings
The appeals court decision came after a federal judge in the city issued two legal injunctions this month – one preventing the federalization of the state troops, and another stopping the use of any military personnel in Oregon, after attempts to circumvent the initial injunction by calling up out-of-state forces.
On Monday, the appeals court had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the second ruling stayed effective, preventing the physical sending of the troops.
En Banc Review
The latest ruling means the issue will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.
“This ruling demonstrates that the truth matters and that the courts are working to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.
“The judicial body is sending a definite signal: the executive leader cannot send the military into American urban areas without cause. We will continue protecting state legislation, principles, and sovereignty as this legal proceeding moves forward and our legal battle continues in the judicial system.”
